An Individual Taxpayer Identification Number (ITIN) is a personal tax ID number. An ITIN is used to file taxes, obtain loans or used to claim a tax credit in the US if you do not have a Social Security Number (SSN) and you fall in one of the categories below:

    1. Nonresident alien who is required to file a U.S. tax return
    2. U.S. resident alien who is (based on days present in the United States) filing a U.S. tax return
    3. Dependent or spouse of a U.S. citizen/resident alien
    4. Dependent or spouse of a nonresident alien visa holder
    5. Nonresident alien claiming a tax treaty benefit
    6. Nonresident alien student, professor or researcher filing a U.S. tax return or claiming an exception
    7. A third party is needing to withhold taxes on your passive income
    8. Wages, Salary, Compensation and Honoraria payments with Tax Treaty Benefits Claimed; or Scholarships, Fellowships and Grants with Tax Treaty Benefits Claimed; or Scholarships, Fellowships and Grants No Tax Treaty Benefits Claimed; or Gambling Winnings with Tax Treaty Benefits Claimed.

Frequently Asked Questions (FAQs) for ITIN

In majority of ITIN application cases (#1-6 above) you will need to apply and attach your passport, or other documents for verifying your identity, and a paper copy of a US federal tax return. In cases of exceptions ( #7-10 above) you to do not need to attach a federal tax return, but you will need other documents to proof the reason why you are eligible for the ITIN. The IRS takes 8-14 weeks to process your application and they keep your documents for that time period if you apply for an ITIN yourself. Yes, if you need to file a U.S. tax return in 2020. But, spouses and dependents residing outside of the U.S. cannot renew their ITIN until they file an individual tax return, or someone else files an individual income tax return claiming them for an allowable tax benefit (such as a dependent parent who qualifies the primary taxpayer to claim head of household filing status). In these instances, they must attach a federal income tax return to their W-7 renewal application.
